Elevo - Terms of Use and License Amira Labs, Inc. · Version 1.1 · October 7, 2026 # 1. Acceptance These Terms govern the use of Elevo, made available by Amira Labs, Inc. ("Amira Labs"). The official site of Elevo is elevo.click. By selecting "Accept and continue", you declare that you have read and understood these conditions, that you agree to them, and that you undertake to use the application lawfully. If you do not agree, do not use the application. You must have the legal capacity to accept these Terms, or the assistance of a responsible person where applicable law requires it. Use on behalf of an organization requires authority to represent it, and in that case the organization is also bound by these Terms. # 2. License Amira Labs grants you a limited, non-exclusive, non-transferable and revocable license to install and use Elevo on devices you own or are authorized to operate, for lawful personal or professional purposes, under the conditions of the version made available. This license does not transfer ownership of the application, of the brand or of its original elements. You may not sublicense, sell, rent or redistribute the application, or remove its ownership notices, except where applicable law or the licenses of third-party components expressly allow it. The rights granted by applicable law and by the licenses of third-party components remain preserved. # 3. Features and permissions Elevo lets you send and receive files between devices and keep the computer awake temporarily. By starting or accepting a transfer, you authorize the operations required on the files and destinations you selected, within the permissions granted to the application. This authorization does not extend to indiscriminate access to other files, nor to the use of the content for purposes other than the operation requested. Check the files, the recipient, the destination folder and any request to replace an item before confirming an operation. # 4. Transfers and integrity The speed and continuity of transfers depend on the connection, the devices, the storage available, the permissions and the operating system. Network interruptions, shutdowns, hardware failures and other events may prevent or interrupt an operation. The verification, recovery and resumption mechanisms that apply are those actually provided in the version in use. Wait for confirmation that a transfer has finished and check the files received before deleting the originals. Keep backup copies of important files. Elevo is not a substitute for a backup solution. No system offers absolute protection against failures or incidents. This does not set aside the obligations of Amira Labs, the characteristics expressly offered or the rights guaranteed by law. # 5. Responsibility for content and prohibited activities You are responsible for the files you choose to send, for the authorizations needed to share them, for the choice of recipients and for the acts you carry out using Elevo. By accepting these Terms, you declare that you will not use the application to carry out, promote or facilitate activities contrary to applicable law, including: - Unauthorized sharing of works, software or other materials protected by copyright. - Illicit drug trafficking, human trafficking or illegal trade in products and services. - Production, distribution, offering or sharing of child sexual abuse or exploitation material, as well as grooming or other forms of exploitation. - Spreading malicious software, fraud, extortion, intrusion into devices or unlawful disclosure of personal information. - Any other conduct that violates the rights of third parties or constitutes a legal offense. Receiving a file does not prove that it is authentic, lawful or safe. The legal consequences of acts carried out by the user will be determined according to the user's conduct and applicable law. The use of Elevo does not make Amira Labs the author of, a participant in or an approver of those acts. This provision does not exclude any liability of Amira Labs itself where the law provides for it. To the extent permitted by applicable law, you will be liable for the losses, claims and expenses that Amira Labs may incur as a result of your unlawful use of the application or your breach of these Terms. # 6. Privacy of files and connection Amira Labs has no access to the content of the files sent or received with Elevo. The local processing required for a transfer does not make those files available to the company. The content transferred is not collected by Amira Labs for analysis, advertising, statistics, commercial exploitation or the training of artificial intelligence. You keep the rights to your files. The use of the application does not transfer their ownership to Amira Labs. Transfers take place between the devices, with end-to-end encryption. When a direct connection is not possible, the encrypted traffic may pass through relay servers and address lookup services operated by third parties, which have no access to the content. The send code and the connection itself may reveal network addresses to the recipient and to those services. Send codes are written as addresses of the site elevo.click: when a code is opened in a browser, it is transmitted to that site. The absence of access to content does not authorize unlawful practices, nor is it a promise of anonymity towards recipients, connection providers or competent authorities. # 7. Usage information and internal statistics By accepting these Terms, you authorize Amira Labs to receive, in order to estimate the number of installations and active users and to prepare internal usage statistics: - The date of installation or of the first use recorded. - The date and time of the last activity recorded by the application. - The type and model of the device, the operating system and their versions. - The installed version of Elevo. - A random identifier of the installation, used to tell installations apart without requiring the user to be identified by name. This information does not include the content of the files sent or received. The record of last activity refers to the use of Elevo and does not authorize the monitoring of other applications or of the general activity of the device. The data will be used exclusively for the statistical purposes described, with no sale, targeted advertising or tracking across applications. Access to it will be limited to authorized people and, where necessary, to providers that process it on behalf of Amira Labs, subject to confidentiality and data protection obligations. This information is sent separately from file transfers and involves its communication to the infrastructure used by Amira Labs. The network address is used only to deliver that communication and is not recorded by Amira Labs with this data. Installation identifiers and technical data will not be presented as anonymous while they can be associated with an installation. You may turn this sharing off at any time in the application's Settings, without losing access to any feature. Nothing is sent before these Terms are accepted. Records will be kept only for the period necessary for the stated purposes and then deleted or anonymized, subject to legal obligations. The rights of access, rectification, erasure, objection and the other rights provided by applicable law remain guaranteed. # 8. Keep Awake and preferences The Keep Awake feature may temporarily change the sleep behavior of the computer and increase its energy consumption. Its operation remains subject to the limits and protections of the operating system and of the hardware. The feature does not prevent interruptions caused by loss of power, restart, shutdown or failures of the device. Sounds, animations and the opening of the folder when a transfer ends are preferences that can be set in the application's options. # 9. Free use, plans and future charges Amira Labs may, at any time, offer paid versions, subscriptions, plans or additional features for a fee. Making a version available free of charge is not a promise that future versions or offers will remain free. Any proposed change that affects conditions already offered to existing users will be communicated in advance, observing the commitments made, acquired rights and the periods required by applicable law. Before any purchase, the price, the billing period, the taxes and other charges that apply, the features included and the conditions for renewal and cancellation will be presented. Accepting these Terms does not authorize future charges, the automatic conversion of free use into a subscription, or any debit without the corresponding authorization. There will be no retroactive charge for the period of free use. The user may decline a new paid offer, with legal and contractual rights preserved. # 10. Intellectual property and third parties The rights in the original elements of Elevo belong to Amira Labs or to their respective owners. Third-party components remain subject to their own licenses. Those licenses prevail over these Terms as regards the corresponding components, including in relation to use, modification, redistribution and access to source code. Nothing here restricts activities expressly permitted by law, including legitimate security research, accessibility and interoperability. # 11. Updates, protective measures and termination Elevo may receive security updates, fixes and improvements. Amira Labs may modify or discontinue the application or part of its features, subject to applicable law. Material changes to these Terms will be communicated before they apply, in the application or at elevo.click, with new acceptance where necessary. When it becomes aware of possible violations through reports or other lawful means, Amira Labs may adopt measures that are proportionate, technically available and legally permitted. This does not imply inspection of the files transferred. Amira Labs may comply with valid legal orders concerning the information it legitimately holds, subject to the applicable rules on data protection and disclosure to authorities. You may stop using the application and uninstall it at any time. The license ends if these Terms are breached. No contractual measure authorizes the deletion of your personal files or the blocking of access to them. # 12. Warranties and liability To the maximum extent permitted by applicable law, Elevo is provided as is and as available, with no warranty that it will operate without interruption, be free of errors or be fit for a particular purpose. To the same extent, Amira Labs is not liable for indirect damages, loss of profits, loss of data or of files, nor for losses arising from content transferred by users or from failures of networks, devices, systems and third-party services. These Terms do not exclude mandatory warranties, liabilities that cannot be limited by law, or rights to correction, repair, refund and compensation guaranteed by applicable law. Amira Labs remains responsible for fulfilling its legal and contractual obligations. The user's responsibility for their own acts does not transfer to the user the responsibility for failures or conduct attributable to Amira Labs. External problems will be considered according to the circumstances of each case. # 13. International application These Terms will be interpreted according to the rules that determine the applicable law and the competent jurisdiction for the case, preserving the mandatory protections of the consumer's country of habitual residence where they apply. It is up to you to observe the laws of the place where you use the application, including export and sanctions rules. You may turn to the authorities, consumer protection bodies and competent courts. These Terms impose no mandatory arbitration and no waiver of class actions or of other means of defense guaranteed by law. These Terms are the entire agreement between you and Amira Labs regarding the use of Elevo. If any provision is found invalid, the others remain applicable to the extent that the contract can legally subsist. No version or translation can set aside mandatory rights.
